KosherBnB LLC – Guest Agreement
Welcome to KosherBnB LLC! This Guest Agreement (“Agreement”) governs your use of our digital platform and services as a guest. KosherBnB LLC (“KosherBnB,” “we,” “us,” or “our”) provides a platform to discover, book, and enjoy kosher-friendly accommodations around the world (the “Services”). By using our Services—including making bookings, communicating with hosts, or staying at any property listed through KosherBnB—you agree to abide by this Agreement, our Terms of Service, Privacy Policy, and any additional policies referenced herein.
1.1 Minimum Age. You must be at least 18 years old and capable of entering into legally binding agreements.
1.2 Account Creation. To book a property, you must create an account with accurate and current information. You are responsible for all activity conducted through your account and for keeping your login credentials secure.
2.1 Booking Process. When you confirm a reservation, you agree to pay all applicable charges, including the rental rate, service fees, taxes, and any other fees outlined at checkout. You also agree to abide by the terms set by the Host for that property.
2.2 Conduct & Compliance. As a guest, you agree to:
Respect the property and its contents;
Follow the Host’s house rules and instructions;
Avoid causing damage, noise disturbances, or nuisance;
Refrain from hosting unauthorized parties or exceeding the agreed guest count;
Comply with all local laws and ordinances.
2.3 Cancellations and Changes. The cancellation policy is determined by the Host and may fall under one of three options: Strict, Moderate, or Flexible. For full details, please refer to our Cancellation Policy page. Changes to a reservation are subject to availability and at the discretion of the Host. If approved, the guest will be responsible for any price differences. Disputes or chargebacks are not accepted.
2.4 Issue Reporting. Guests have 24 hours after check-in to report any issues that may prevent TheKosherBnB from fully paying the Host.
2.5 Security Deposit. The Host has 24 hours after check-out to report any damages caused by the guests. If the Host does not report damages within this timeframe, TheKosherBnB will consider the security deposit refundable to the guest. Some Hosts may require the security deposit to be paid directly prior to check-in. In such cases, the refund is handled by the Host, not TheKosherBnB. Please refer to the property details to determine who is responsible for holding and refunding the security deposit.
3.1 Authorization. By entering payment details, you authorize KosherBnB or our payment partners to charge your payment method for the total amount shown at checkout.
3.2 Platform Fee. KosherBnB charges guests a 5% service fee on each booking. This fee is intended to cover merchant account fees, website maintenance, and other platform-related service costs. It is not designed to generate profit, but to support continued improvements, reliable operations, and a high-quality user experience.
Guests are expected to leave the property in the condition it was found. You must report any damage promptly to the Host and KosherBnB. In cases of damage:
KosherBnB may charge your payment method to cover repair or replacement costs;
We may also pursue reimbursement through collections or legal means, if necessary.
KosherBnB is not a party to the rental agreement between guests and hosts. We do not own, manage, or control the listed properties. Our role is limited to facilitating bookings and payment processing.
We do not guarantee the condition, safety, legality, or availability of any listing.
You agree not to:
Violate any applicable law or regulation;
Harass or discriminate against any individual;
Misuse the platform for fraudulent or illegal activity;
Circumvent service or platform fees;
Use bots, scrapers, or other automated tools to access the site.
KosherBnB reserves the right to suspend or terminate your account for any violation of this Agreement.
Your personal information is handled in accordance with our Privacy Policy, which explains how we collect, use, and protect your data.
8.1 As-Is Basis. The Services are provided “as is” without warranties of any kind.
8.2 Liability Limits. To the maximum extent permitted by law, KosherBnB shall not be liable for indirect, incidental, or consequential damages. Our total liability will not exceed the amount you paid through our platform for the reservation in question.
You agree to defend, indemnify, and hold harmless KosherBnB and its officers, employees, and affiliates from any claims or liabilities arising out of:
Your use of the Services;
Your stay at any listed property;
Your violation of this Agreement or applicable laws.
10.1 Governing Law. This Agreement is governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.
10.2 Arbitration. Any disputes shall be resolved by binding arbitration in Miami-Dade County, Florida, unless otherwise required by law. You waive your right to jury trials and class action participation.
Entire Agreement. This Agreement, along with our Terms of Service and Privacy Policy, represents the entire understanding between you and KosherBnB.
Severability. If any provision is deemed unenforceable, the remainder of the Agreement will remain in effect.
No Waiver. Our failure to enforce any right or provision is not a waiver of that right.
Assignment. You may not assign this Agreement without written consent from KosherBnB.
