KosherBnB LLC Host Agreement
Welcome to KosherBnB LLC! This digital platform allows you and/or your business ("Host") to efficiently list and manage properties or services for rent to individuals and businesses worldwide. The platform is operated by KosherBnB LLC and gives Hosts exposure to local, national, and international markets through inquiries generated via our website and app.
By using this platform, you consent to the terms and conditions outlined below and confirm your agreement upon first login. These Host Terms govern your rights and obligations and incorporate our General Terms of Service, Payment Terms, Privacy Policy, and all referenced policies.
1. Nature of the Platform
KosherBnB serves as an online conduit, allowing Hosts to communicate rental availability to potential Guests and for Guests to submit booking requests. KosherBnB is not a party to any agreement between Host and Guest and does not guarantee the accuracy, legality, or quality of any listing or user.
KosherBnB LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THOSE PERTAINING TO USER TRANSACTIONS, LISTINGS, OR INFORMATION ON THE PLATFORM.
2. Host Eligibility
To create a listing, you must:
Be at least 18 years old.
Be authorized to rent or offer the services listed.
Hold required licenses, permits, and insurance.
Provide truthful, complete, and up-to-date information.
You confirm that your listing complies with all laws including zoning, health, and landlord-tenant regulations.
3. Platform Access and Security
Only registered Hosts with authorized login credentials may access the platform. You agree to:
Maintain confidentiality of your access codes.
Take responsibility for all activity under your account.
Notify KosherBnB of any breach immediately.
Unauthorized access may result in account suspension and legal consequences.
4. Creating and Managing Listings
Hosts must:
Accurately represent property or service details (address, pricing, amenities, availability, rules).
Keep listings current and disclose any hazards.
Not mislead or manipulate booking availability.
KosherBnB reserves the right to edit, remove, or suspend listings that breach platform policies or applicable laws.
5. Host Responsibilities
Hosts must:
Fulfill the listing as described.
Maintain the property in safe, clean, and habitable condition.
Provide a point of contact for guest support.
Comply with all legal, tax, and regulatory obligations.
If a Guest discovers a listing through KosherBnB or affiliated channels but the booking is completed off-platform, the Host agrees to pay KosherBnB a service fee equal to 10% of the gross booking amount.
6. Booking and Payments
Guests must provide valid payment methods. KosherBnB securely processes payments.
Confirmed bookings authorize KosherBnB to process total payment including fees and taxes.
Payments to Hosts are made 24 hours after Guest check-in, less applicable fees.
KosherBnB is not liable for payment disputes or chargebacks; Hosts must address Guest issues promptly.
7. Fees and Taxes
KosherBnB charges a 10% service fee on confirmed and paid bookings.
Posting listings is free. Unlimited listings are allowed.
Hosts are responsible for filing and remitting all taxes.
U.S.-based Hosts must submit a W-9 and banking details for fund disbursement.
8. Insurance and Liability
Hosts should carry appropriate insurance including:
Property and liability insurance for short-term rentals.
Commercial general liability insurance with at least $1,000,000 coverage.
KosherBnB is not an insurer and does not provide or guarantee protection against losses.
9. Cancellations and Modifications
Cancellations must comply with KosherBnB’s cancellation policies. Excessive or last-minute cancellations may lead to:
Fines;
Loss of listing visibility;
Account suspension.
Changes must be agreed with Guests and documented per platform procedures.
10. Compliance and Conduct
Hosts agree to:
Adhere to local laws for short-term rentals.
Respect community standards and nondiscrimination policies.
Provide a safe and sanitary environment.
KosherBnB may suspend or remove listings for violations of these terms or risk to guest safety.
11. Disputes and Damages
Hosts must report property damage within 24 hours of Guest checkout.
KosherBnB may facilitate resolution but is not liable for compensation.
Chargeback disputes will be handled as a courtesy; final responsibility remains with the Host.
KosherBnB may recover loss amounts by debiting Host payouts or pursuing other remedies.
12. Intellectual Property
By uploading content, you grant KosherBnB a royalty-free, non-exclusive license to use, reproduce, and market your Listing. You affirm all submitted content is owned or properly licensed.
13. Account Suspension and Termination
KosherBnB may suspend or terminate your account with 14 days' notice or immediately in severe cases (fraud, legal risk, harm to reputation). You may terminate your account upon resolving all outstanding obligations.
14. Limitations of Liability
To the fullest extent permitted by law:
KosherBnB is not responsible for indirect, incidental, or consequential damages.
Total liability is capped at the Host service fees earned in the 6 months prior to any claim.
15. Indemnification
You agree to indemnify and hold KosherBnB harmless from any claims arising from:
Your Listings or services;
Your violation of these Host Terms or applicable laws.

17. Data Protection
Hosts must comply with all data privacy laws (e.g., GDPR, CCPA) and safeguard guest data from unauthorized use, loss, or disclosure.
18. External Links and Site Content
KosherBnB is not responsible for the content or legality of external links. You may use site materials for personal, non-commercial purposes only. Commercial use requires prior written consent.
Framing or embedding KosherBnB content requires express written permission.
19. Governing Law and Dispute Resolution
These terms are governed by Florida State law. Any disputes must first be submitted to a Beth Din in Florida. If unresolved within 90 days, parties may proceed exclusively in the state courts of Broward County or the U.S. District Court for the Southern District of Florida.
Claims must be filed within six (6) months of the incident.
20. Updates and Amendments
KosherBnB may amend these terms from time to time with notice. Continued use of the platform signifies acceptance of updates.
21. Entire Agreement
These Host Terms and General Terms constitute the full agreement between you and KosherBnB. If any part is deemed unenforceable, the remainder shall still apply. Failure to enforce any term does not waive it.
